The Food Safety and Standards Authority of India has initiated three adjudication cases against Nestle India over alleged regulatory violations involving infant nutrition products.
The proceedings concern NAN Excella Pro Stage 1, Lactogen Pro 1 and a follow-up formula manufactured by the company. FSSAI reviewed the products along with promotional material available on e-commerce platforms.
The regulator raised concerns about certain promotional claims and also identified a nutritional composition issue involving biotin in a sample of the follow-up formula.
For NAN Excella Pro Stage 1, the legal notice refers to promotional claims involving “5 HMOs” and “Whey Protein”. FSSAI sought clarification from Nestle India and later stated that the product contravened Regulation 4(2) of the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020, which restricts promotional material intended to increase the saleability of infant foods.
However, the action does not mean the products have been banned or that all batches are unsafe. The final outcome will depend on the adjudication process.
Nestle India said, “Our products are fully compliant with all the applicable regulations.” The company also said the products and their labels were approved by an FSSAI expert committee and that it had submitted a detailed response to the authorities.
