New Delhi: Three Cockroach Janta Party (CJP) leaders, Abhijit Dipke, Saurav Das and Ashutosh Ranka, were ordered to be released by a Delhi Executive Magistrate court on Sunday on the condition that they refrain from activities that could disturb peace and tranquillity for the next one year.
The leaders had been taken into preventive custody by Delhi Police ahead of a planned protest against Chief Election Commissioner Gyanesh Kumar.
Their advocate confirmed the condition imposed by the court, while Ratna Singh, head of legal affairs at CJP, also announced their release in a post on X.
The trio were produced before the Special Executive Magistrate for South West District at the Delhi Cantonment police station following their detention. Police had taken them into custody immediately after their flight landed in the national capital, where they had arrived to participate in the demonstration.
Delhi Police invoked Sections 126 and 170 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) against the three leaders.
Section 126 empowers an Executive Magistrate to require a person considered likely to disturb public peace to execute a bond for maintaining tranquillity for a period of up to one year. Section 170 permits preventive arrest without a warrant when police believe a cognisable offence is being planned and cannot otherwise be prevented.
An arrest under Section 170 is ordinarily limited to 24 hours unless further detention is authorised under another legal provision.
